Terms and Conditions — Paceva Analytics

1. Introduction

These Terms and Conditions ("Terms") govern the use of the Paceva mobile application ("the Application") and the associated website. By accessing or using the Application, you agree to be bound by these Terms.

2. User Accounts

To use certain features of the Application, you may need to register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. License of Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application for personal, non-commercial training analysis, subject to payment of any applicable fees or subscriptions.

4. User Data & Ownership

The workout files (FIT, GPX, TCX) and biometrics you analyze using the Application remain your property. All calculation and processing occur locally on your device. We do not claim ownership over any of your training data.

5. Subscriptions & Payments

If the Application offers premium subscription plans, billing and subscriptions are processed and managed through the Apple App Store. All payment disputes and cancellations must be handled directly with the App Store.

6. Safety & Limitation of Liability

Paceva is an analytical tool provided "as is". Training calculations (including W' Balance, zones, and recovery metrics) are estimates. We are not responsible for any physical injury, health issues, or performance issues resulting from your training. Always consult with a qualified coach or physician before undertaking intense physical exercise.

7. Changes to the Terms

We may update these Terms from time to time. Your continued use of the Application after changes are posted constitutes your acceptance of the updated Terms.
